Australia introduces Media Bargaining Code

The Australian Competition and Consumer Commission has released a draft of the News Media Bargaining Code for public comments. The draft aims to regulate the negotiation procedures between digital platforms and news businesses for fair payment schemes, such as securing fair payment for content, addressing the power imbalance between publishers and digital platforms, and providing arbitration and settlement procedures in case negotiations fail. The code is aimed at Google and Facebook, but foresees expansion to other platforms in the future. Public comments are to be submitted by 28 August 2020.
