US Secretary of Commerce announces the fulfillment of EU-US DPF commitments

US Commerce Secretary confirms US implementation of EU-US Data Privacy Framework, while Attorney General designates EU and EEA countries as “qualifying states” under EO 14086, strengthening safeguards for signals intelligence.

The US Secretary of Commerce, Gina Raimondo, stated that the US fulfilled its commitments to implement the EU – US Data Privacy Framework (DPF) to enable data flows while safeguarding individual rights and personal data. This achievement follows extensive collaboration between the US. and the EU. Attorney General Merrick Garland designated the EU and three countries making up the European Economic Area (EEA) as “qualifying states” under Executive Order (EO) 14086, establishing redress mechanisms for US Signal Intelligence Activities. Raimondo states that this designation, coupled with adopting implementing procedures by the US Intelligence Community, strengthens the safeguards for signals intelligence activities. The effectiveness of the designation will depend on the EU’s adoption of an adequacy decision for the EU – US DPF. Today, July 3 2023, the Office of the Director of National Intelligence (ODNI) has confirmed that the U.S. Intelligence Community has implemented its policies and procedures in accordance with EO 14086.
