Pre-ticked box insufficient consent to use cookies by the end user, Court of Justice of the European Union rules

In case C 673/17 Bundesverband der Verbraucherzentralen und Verbraucherverbände   ̶ Verbraucherzentrale Bundesverband eV v Planet49 GmbH the Court of Justice of the European Union (CJEU) has delivered a preliminary opinion on consent to use cookies by the end users. CJEU has noted that consent must be specific, so that the fact that a user selects a button is not sufficient for valid consent to the storage of cookies. According to the CJEU, the service provider must give to a user information on the duration of the operation of cookies and whether or not third parties may have access to those cookies.
