How should US courts view websites & the Americans with Disabilities Act?

US lower courts are not clear on how the the Americans with Disabilities Act should be applied to the Internet and online resources. This is an issue of importance right now, as US President Obama carefully considers the appointment of the next US Supreme Court Justice.

In his Huffington Post article  Appoint a Justice Who Understands Disability, Mark Riccobono calls on Obama to appoint a justice who sees persons with disabilities as true equals, noting that those who have experience with a disability, or close interactions with persons with disabilities, can more easily understand that capacities, needs, and rights are the same for those with disabilities, as the rest of the population, including those who face other forms of discrimination.
