European data protection supervisor shares its opinion on draft e-Evidence law

The EDPS released its opinion on the draft e-Evidence proposal, a legal  framework  that  would  make  it easier  and  faster  for  police  and  judicial authorities to secure and obtain access to electronic evidence in cross-border cases. Though it supports the objective of the proposal, the EDPS is concerned about proposed safeguards, and recommend reassessing the balance between the type of offenses for which this legal framework would apply. The EDPS also asked for further clarity on the interaction of this new text with international agreements, such as the Convention on Cybercrime of the Council of Europe.
