CJEU rules on address disclosure in case of illegal uploads

The Court of Justice of the EU (CJEU) has issued a judgment in the case C-264/19 Constantin Film Verleih GmbH v YouTube LLC and Google Inc. related to the disclosure of information in case of proceedings on infringement of intellectual property rights.

The CJEU has clarified the interpretation of  Article 8(2)(a) of the Directive 2004/48/EC of the European Parliament and of the Council from 29 April 2004 on the enforcement of intellectual property rights, stating that when a film is unlawfully uploaded to an online platform, such as YouTube, the rights holder ‘may require the operator to provide only the postal address of the user concerned, but not his or her email, IP address or telephone number’.
