Law of the Sea – Law of the Internet: Inspiring Analogy?
The analogy between the Internet and open sea has been around for some time. More recently, Admiral Rogers, the new director of the US National Security Agency (NSA), suggested that the Law of the Sea should inspire future regulation of the Internet. Dr Alex Sceberras Trigona, former minister of foreign affairs, will address the question of possible analogies between the Internet and Law of the Sea.
The applicability of the Law of the Sea to the Internet was discussed during the Malta Conference on the Internet as Global Public Resource (29-30 April 2015). At the Malta conference in April Dr Trigona drew comparisons between the concept of the Common Heritage of Mankind as enshrined in the UN convention on the Law of the Sea (UNCLOS) and its potential use to underpin any regulatory framework for the Internet be it a set of bilateral agreements or a UN Convention
