Fox vr. TVEyes revised decision

After more than 2 years of  District court decision that TVEyes did not violate Foxx copyrights and its acts are covered under fair use doctrine, the Second Circuit Court reached opposite conclusion. TVEyes created text-searchable database of television programing, where its users could find part of programming by looking for words used in that programme. The Second Circuit Court decided that TVEyes activities cannot be covered under fair use doctrine since: the nature of content is not of significant transformative nature, they used a lot of Fox content and charged for it. Hence, TVEye deprived Fox from incomes of licensing agreements. Due to all these reasons court dismissed fair doctrine argument for TVEyes and imposed new and broader injunction.
