Principles and Recommendations

The recommendation contains principles member state of the Council of Europe should be guided by when reviewing their internal legislation and practice concerning criminal procedural law. The principles concern searching computer systems and seizing data; laws pertaining to technical surveillance; obligations of subjects to co-operate with the investigating authorities; further development of procedures and technical methods for handling electronic evidence to ensure their compatibility between states; minimising the negative effects of the use of cryptography on the investigation of criminal offences without affecting its legitimate use; research, statistics and training; and negotiation and supplementing international agreements to facilitate international co-operation between investigating authorities.
