Lokman Emrek v. Vlado Sabranovic

Lokman Emrek (consumer), a German resident brought a case against Vlado Sabranovic (seller), a French resident who sold used cars through a website. Emrek filed a complaint against Sabranovic in Germany under the warranty agreement insisting that according to article 15 (1) lit. c) 16 (1) of the Brussels I-regulation, German courts were competent for the matter given that Sabranovic’s activities were targeted through the website at Germany. The Court of Justice of the European Union ruled that a consumer can bring a case against the foreign seller with whom he/she has concluded a contract before the national courts if it can been established that the trader directed his activities to the consumer’s State.
